These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and YUMM AI ("Company," "we," "us," or "our") concerning your access to and use of the YUMM AI platform and related services.

YUMM AI provides a cloud-based platform that enables restaurants to:

• Create and manage digital menus
• Translate menus into multiple languages
• Generate QR codes for menu access
• Create branded QR codes with custom logos (Silver+ plans)
• Access analytics and performance metrics (Gold+ plans)

By using our service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to enter into these Terms
• You will provide accurate and complete information during registration
• Your use of the service will comply with all applicable laws

4.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

4.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

5.1 Plan Tiers

• Free Plan: Limited features (1 language, up to 5 menu items, basic QR display)
• Bronze ($19.99/month): Unlimited menu items, 10 languages, QR downloads
• Silver ($29.99/month): 20 languages, branded QR codes
• Gold ($79.99/month): 35 languages, analytics dashboard
• Platinum ($129.99/month): Unlimited languages, enhanced analytics, AI Waiter PRO

5.2 Payment Terms

• Subscription fees are billed monthly in advance
• All payments are processed securely through Stripe
• Prices are subject to change with 30 days' notice
• Failed payments may result in service suspension

5.3 Refunds

• Refund requests must be submitted within 14 days of initial charge
• Subsequent monthly charges are non-refundable
• Pro-rated refunds are not available for mid-cycle cancellations
• Refunds are issued to the original payment method within 5-10 business days

6.1 User Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You retain access until the end of your billing period
• No further charges will be made
• Your data will be available for download for 30 days
• After 30 days, your data may be permanently deleted

6.2 Company Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the service in a manner that could harm our infrastructure

7.1 Your Content

You retain all ownership rights to your menu content, images, and data ("User Content"). By using our service, you grant us a limited license to store, display, translate, and create QR codes for your content.

7.2 Content Restrictions

You may not upload or share content that:

• Infringes on intellectual property rights
• Contains malicious code or viruses
• Violates any applicable laws
• Is fraudulent, false, or misleading
• Contains hate speech or discriminatory content

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Scrape or extract data from the platform
• Reverse engineer or decompile our software
• Resell or redistribute our service without permission

While we strive for 99.9% uptime, we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YUMM AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

YUMM AI commits to donating 5% of net profits to feed starving children around the world. This commitment is a core part of our mission but does not create any third-party beneficiary rights.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
